If you want to sell on Amazon Europe, an active account or approved listing is not proof that your product is legally ready for the EU. A non-EU business expanding the same SKU across several marketplaces should review three separate layers: product compliance, Extended Producer Responsibility (EPR) and VAT.
Amazon connects markets commercially, but it does not create one legal setup for every country. Inventory location can materially affect VAT, while expansion into new markets can add EPR, language and other country-specific requirements.
What do you actually need to sell on Amazon Europe?
First confirm that the product can legally be placed on the EU market. Then map EPR by product stream and country, and plan VAT around the real import, storage and sales model. FBA can change where stock is held, but it does not replace any of these checks.
1. Product compliance: make sure the product can legally be sold in the EU
Start with the product, not Amazon. Function, intended use, design and category determine which EU legislation applies and what documentation, testing, labelling and economic-operator arrangements are required.
CE marking is not required for every product
CE marking is mandatory only where the applicable EU harmonisation legislation requires it. There is no universal EU-issued “CE certificate”. If you are unsure, see which products need CE marking.
Where CE marking applies, the manufacturer normally needs the relevant conformity assessment, technical documentation and EU Declaration of Conformity, together with the required markings and product information. GPSR, labels, online listings and the EU responsible person
The General Product Safety Regulation (GPSR) has applied since 13 December 2024. It is the horizontal EU product-safety framework and can complement sector-specific legislation where a relevant safety aspect is not covered. For Amazon sellers, traceability details, manufacturer or responsible-person information and relevant warnings may also have to appear in the online offer. A non-EU manufacturer must also identify the correct EU-based economic operator where required. An EU Responsible Person is not automatically the same as an Authorised Representative; the valid operator depends on the applicable legislation and supply chain.

EPR is separate from product conformity. It can apply to packaging and, depending on the product, to electrical/electronic equipment or batteries. A CE-marked or GPSR-compliant product can therefore still have outstanding EPR obligations.

3. VAT: plan registrations before Amazon moves your stock
VAT depends on the real transaction and fulfilment structure, especially where inventory is imported and stored. An active listing alone does not automatically create a local VAT registration requirement.
The Union One Stop Shop (OSS) can simplify certain intra-EU B2C distance sales, but it does not replace every domestic VAT registration, particularly where stock is stored locally. Fiscal-representation requirements for non-EU businesses also vary by jurisdiction.

How FBA and Pan-European FBA change the compliance map
FBA does not transfer applicable product-compliance responsibilities to Amazon. In an Amazon FBA Europe setup, inventory location is especially important for VAT.
Amazon currently identifies France, Germany, Italy, Spain and Poland as Pan-European FBA storage countries. For the standard programme, Amazon instructs sellers to obtain VAT registrations where storage is enabled. Expansion can separately add EPR, language and other national requirements.

- Treating an approved Amazon listing as proof of legal compliance.
